Read the latest out-of-service order before you send the load

You already have the carrier. Check whether the out-of-service order is still open. The copy is $35 once, or Broker Pro at $129 a month.

You already have the USDOT. ClearTheTender reads the order with the latest order date. The flag is on only when that order has no rescind date and the date is within 365 days.

The order this page reads

Montgomery v. Caribe Transport II (May 14, 2026) held that a negligent-hiring claim against a broker is not preempted, because states still regulate safety with respect to motor vehicles. This page reads the order with the latest order date in FMCSA’s Out-of-Service Orders file for that USDOT: order date, rescind date, and reason.

When does ClearTheTender turn the flag on?

The out-of-service flag turns on only when that order has no rescind date and the order date falls within the last 365 days. An order dated exactly 365 days ago still counts. When the flag is on, the lookup shows the order date and the reason. When the flag is off, those two fields do not appear on the card.

Crash Indicator and HM Compliance stay padlocked for property carriers under the FAST Act. We do not invent those values.

What the search cannot show you

Search reads the order file we stored. It does not open a SAFER session. The card does not list every older order. If the latest order has a rescind date, the flag is off, even when an older order was never rescinded. An unrescinded order older than 365 days does not turn the flag on. Census operating status can still say ACTIVE while the flag is on.

Look up the USDOT

The copy is $35 once, a frozen PDF with a SHA-256 hash. Broker Pro is $129 a month for up to 500 USDOTs, with a daily email when one is out of service or FMCSA has flagged them.

Questions

When does ClearTheTender mark a USDOT out of service?

ClearTheTender marks a USDOT out of service when the order with the latest order date has no rescind date and that date falls within the last 365 days. An order dated exactly 365 days ago still counts. The lookup then displays the order date and the reason.

What happens when the latest order has a rescind date?

The flag is off. An older order that was never rescinded does not turn it back on. FMCSA’s public out-of-service list keeps a rescinded carrier for 15 more calendar days, then removes the name.

Does an unrescinded order older than 365 days turn the flag on?

An unrescinded order older than 365 days does not turn the flag on. Census operating status can still say ACTIVE while a newer unrescinded order is on file.

Running a broker desk?

Broker Pro watches a CSV of up to 500 USDOTs and sends a daily email when one is out of service or FMCSA’s alert flag is on. The dossier keeps the measure, the alert, and the out-of-service status from that day, not a ranking we invented.
