Terms of Service
Welcome to ClearTheTender ("the Website"). By accessing or using the Website, you ("User") agree to these Terms of Service. If you do not agree, please do not use the Website.
1. Use of the Website
- You agree to use this Website only for lawful purposes and in compliance with all applicable laws and regulations.
- Carrier records are shown for informational due diligence. They are a snapshot of what FMCSA published, not a recommendation to hire.
- Automated scraping, crawling, or reuse of site content or listings by bots, AI agents, or competitors is strictly prohibited.
- You may not submit false information or tamper with any content or security features.
2. Carrier records and purchases
- Public carrier records come from FMCSA and related federal files. We do not invent percentiles or unlock Crash Indicator / HM for property carriers.
- A one-time Due Diligence Dossier and Broker Pro subscription are paid products. Prices are posted on the site.
- We may refuse or revoke access for abuse, scraping, or unpaid chargebacks.
- This is not a carrier listing marketplace, phone directory, or load board.
3. Intellectual Property
- All content, directory listings, and site design are protected by copyright and database rights.
- No content may be copied, replicated, posted elsewhere, or used for the creation of competing products without written consent.
- Automated scraping or data extraction (manual or automated) is forbidden.
- The compilation of ClearTheTender records, dossiers, and site design is proprietary intellectual property of ClearTheTender.
4. Account Registration & Security
- Users must provide accurate information for any account or listing registration.
- You are responsible for maintaining the confidentiality of your account and for all activity occurring under it.
- We may suspend or terminate accounts suspected of fraudulent or abusive activity.
- Accounts must use a real email you control. Broker Pro and dossier access stay on that email.
5. Fees, Payments, and Refunds
- Due Diligence Dossiers are one-time payments. Broker Pro is a monthly subscription billed through Stripe.
- All fees are non-refundable except where required by law.
- We reserve the right to change pricing or features with 30 days notice.
6. Limitation of Liability
- FMCSA data can be incomplete, late, or later rescinded. We do not guarantee completeness.
- No warranty is provided for hiring outcomes. A dossier is a record of what was published, not a clearance to dispatch.
- Under no circumstances will the Website be liable for damages from use of the records, including direct, indirect, incidental, or consequential damages.
7. Third-Party Links and Services
- The Website may contain links to external sites and third-party services. We do not endorse or control third-party content.
- Users engage with carriers at their own risk. Check the source files when a hiring decision depends on them.
8. Anti-Scraping & Data Protection
- Use of any automated software, bots, or scripts to retrieve, scrape, index, or otherwise collect Website data is strictly prohibited.
- Violations may result in legal action, IP blocking, and notification of relevant authorities.
- Commercial reuse of ClearTheTender records without written permission is forbidden.
9. Governing Law
These Terms of Service are governed by the laws of the State of Texas, United States. Any disputes arising from these terms or use of the Website shall be resolved in the courts of Texas.
10. Changes to These Terms
We reserve the right to modify these Terms at any time. Updates will be posted on this page with the effective date. Continued use of the Website after changes constitutes acceptance of the new terms.
